Four justices questioned a New York City lawyer on Tuesday
about the 16-ounce limit on sweetened drinks at city-licensed restaurants.
The justices wanted to determine if health officials
overstepped their power by placing the limit.
The city attorney was challenged to defend the scientific and legal reasoning behind the limit.
The limit applies to fast food eateries, fine restaurants,
and sports stadiums; however, this would not apply to supermarkets or to some
convenience stores.
This ban on large, sugary drinks came from NYC Mayor Michael
Bloomberg and was struck down because it was seen as an “illegal overreach of
executive power”.
